A Dar es Salaam High Court In Tanzania on Wednesday 28th Aug 2024 directed the Police Force to investigate the whereabouts of the leaders of the CHADEMA Youth Council (BAVICHA) from Temeke District, in Dar es Salaam Region who have been missing since August 18, this year.
The victim’s Lawyer Peter Madeleka had sued the Inspector General of Police, the Dar es Salaam Special Police Commander, the Head of Investigations in Temeke District, the Director of Public Prosecutions, and the Attorney General for illegally arresting and detaining his clients. Madeleke sorts the court’s intervention to direct authority to produce the Bavicha Leaders in court.
In its ruling, the court said there was insufficient evidence to prove BAVICHA leaders were being held illegally by the police force. But directed the police to immediately commence the investigations of where the ‘’missing’’ individuals are
Madeleka said they respect the court’s decision but disagree with the verdict hence they will move to a higher court to appeal the ruling.
‘’as the prosecution team we are not satisfied with the court’s decision, so we shall appeal the ruling to ensure Soka and his colleagues are found and the kidnappers held accountable’’ Said Madeleke
The missing leaders are Bavicha’s Temeke District Chairman Deusdedith Soka and his secretary, Jacob Mlay, and their motorcycle driver, Frank Mbise.
The three were allegedly picked up by police on 18th August 2024 and their whereabouts are unknown to date.
