The Director of Public Prosecutions (DPP) has opposed an application for bail pending appeal by Mohamed Abdi Ali, one of the men convicted over the 2019 Dusit D2 terror attack that claimed 21 lives.

In submissions filed before the court, Senior Assistant Director of Public Prosecutions Duncan Ondimu argued that the applicant had failed to demonstrate exceptional circumstances to justify his release, maintaining that bail pending appeal is not an automatic right.

The prosecution also dismissed Ali’s health-related grounds, citing a medical report from Kamiti Maximum Security Prison indicating that his conditions remain stable and can be managed within the facility.

The application was scheduled for hearing on Wednesday but was deferred after the court found the record incomplete. The matter has been set for a virtual hearing on November 12, 2026, alongside a similar application by co-convict Hussein Mohamed Abdille Ali.

The two were convicted on May 22, 2025, over their involvement in the January 2019 Dusit D2 attack and were each sentenced to 30 years in prison on June 17, 2025.
